We aim to promote the good functioning of a competitive market as a means to maximise the efficient delivery of waste management services and deliver value for money for taxpayers. Waste management provides services of general economic interest for the collection and treatment of municipal and industrial waste. Close cooperation with local authorities is unavoidable and can take different forms. In most member states, the private sector has a major role in the management of industrial waste. Municipal waste is managed by the municipalities or the service may be contracted out to the private sector. The local authority may deliver the waste management service itself (self-provision), and it can be delivered privately. In that case the authority will make a public tender in accordance with European public procurement rules. Between these two aspects, different forms of cooperation exist across Europe: public private partnerships (PPPs), concessions. The European waste management sector generally recognises the benefits of PPPs and the appropriate risk transfer that can be achieved through such collaborations. However, experiences of severe competition issues which can hamper the efficient functioning of a competitive market are reported in several member states. These can create market distortions, reduce efficiency and lead to higher household costs. Unfair competition between the public andthe private sector is of high concern for the efficiency of the waste management sector and is of particular importance in view of the implementation of the newly adopted revised waste framework directive. A fair competition climate and good partnerships between the public and private sectors will help member states implement the waste framework directive in the best way and comply with the ambitious targets that it sets at local level.“The European waste management sector generally recognises the benefits of partnership agreements between the public and private sector” The establishment of collection and recycling schemes, as requested by the directive, will require good collaboration between local authorities and the private sector. Separate collection schemes for at least paper, metal, plastic and glass will have to be implemented at local level by 2015. Moreover, a recycling target of minimum 50 per cent by weight for household and similar waste and minimum 70 per cent for construction and demolition waste is to be met by 2020. It may imply the creation of new or further local recycling schemes. The experience of the private sector will be needed to help local authorities put in place appropriate facilities for differing local circumstances. In this regard, it is of key importance that public and private companies are treated on an equal basis. Negative market distortions, for instance in the field of take-back obligations, should not be imposed in the future. The directive also requires member states to establish waste management plans, which will set out an analysis of the current waste management situation as well as the measures to be taken to meet the objectives of the directive. The waste framework directive provides the legal basis for future waste management policies at national and local level, and thereby guides future waste management strategies as well as the midto long-term vision for local authorities’ planning and private sector investments. Fair competition and good partnerships between the public and private sectors will provide the platform for sound local waste management. Considering the challenges set by the new European framework legislation on waste, it is in the interest of both local authorities and private companies to cooperate in the best way to achieve a high quality waste management sector in Europe that minimises impacts to the environment and human health in the most cost-efficient manner possible.
